Client found capable of managing own affairs
Verdict
Estranged daughter of elderly client attempted to get
guardianship for client and assume control of multi-million
dollar estate. After a trial, the court determined
that our client was not in need of any kind of guardianship
and could continue to manage her own affairs. We
had reason to believe this case was primarily about
the daughter's attempt to challenge our client's last
will and testament (even though our client is still
alive), which made the defense of our client's mental
capabilities all the more important.

Road Construction Accident/Soft Tissue Injuries
Client was entering the interstate when a large
piece of construction equipment made an unexpected turn in front of him. Client was taken to the local
ER but was promptly released. Within several days, he developed a problem
with neck pain which ultimately resulted in a surgical implantation of a neurostimulator. Defense
contended all the injuries were pre-exisiting and that the surgery was unnecessary. Road
contractor paid more than 4 times client's actual damages at second mediation.
$750,000.00 Settlement
Truck/Car accident - Significant Closed Head Injury
This case was made more difficult because
of inadequate investigation by police. As a result,
the police report placed blame on our client.
Despite these problems, we were able to prove the trucking
company and its driver violated a number of safety regulations
mandated by the Department of Transportation, that the
accident occurred as a result of the truck driver's
negligence and that our client did nothing to cause
the accident.
$675,000.00 Settlement
Single vehicle accident - Orthopedic Injuries
Our clients had just leased
a trailer and ditching equipment from an equipment rental
company. The rental company employees loaded the
ditcher on the trailer and hooked the trailer up to
the clients' vehicle.

Shortly after leaving the business, the equipment came
loose on the trailer and flipped the trailer and vehicle
over, injuring our clients.
$500,000.00 Settlement
Pickup Truck/Car accident - Orthopedic injuries

Construction Accident - Paraplegia
Our client was an employee
of a fourth-tier contractor working on a project for
a major phone company. Despite extensive contracts between
the project owner and intervening contractors which
put all responsibility on the client's employer, we
were able to get settlement contributions from all parties
to the lawsuit.
$3.8 Million Settlement
Products Liability - Significant Brain Injury
Our client was operating
a piece of construction equipment. He was attempting
to exit the equipment while leaving the engine running.
This action was a violation of a safety label inside
the operator's compartment. The safety shut-off equipment
malfunctioned and he was caught by the neck for approximately
12 minutes. He suffered severe brain injury. The corporate
defendant denied liability claiming client violated
safety warning. Case settled just before trial.
$575,000.00 verdict

working in maintenance department. He had no experience
doing the job he was given and no training on safety

he plugged in equipment. The equipment malfunctioned
and he received a serious electrocution injury which

over his automobile. Defendant refused to compensate

the date of the divorce until the date of his death.

punitive damages. The entire verdict was sustained on
appeal.
$5.9 million settlement
Truck/automobile accident - Death
Client's vehicle was run
over by a large commercial truck while she was making
a left turn. The accident occurred left of the center
line in the road. We were not involved in this case
until almost 2 years after the accident and less than
75 days before trial. The initial police report was
very damaging because the trucker claimed our client
was on the shoulder of the road, he moved just left
of center as he was going by her car to give her room,
and she suddenly turned left in front of him. We had
to use the surveying data the defense's accident reconstruction
engineer gathered 2 days after the accident to prove
the police officer was wrong. Case settled on the eve
of trial.
